GREAT HARWOOD

The Will of William Breathwaite 1825

This is the last Will and Testament of me William Breathwaite of Great Harwood, in the County Palatine of Lancaster, Yeoman. I direct that all my just Debts, Funeral Expenses, and the Charges attending the Probate of this my Will, shall be paid and discharged by my executors, herein afterwards named out of my Personal Estate, as soon as conveniently may be after my Decease. And I give and Devise unto my Son William Breathwaite all those my two Messuages or dwelling Houses with the Outhouses and other Appurtenances thereunto belonging and also all those several Closes Closures Pieces and Parcels of Meadow and Pasture Ground thereunto also belonging situate and being in Great Harwood aforesaid Containing by Estimation Eleven Acres of Ground of the Measure there Used or thereabouts be the same more or less, and now in the Occupation of myself, my Daughter Cicely and John Radcliffe to hold the same unto and to the Use of my son William Breathwaite during the Term of his natural Life And at my said Son William Breathwaites Decease I give and Bequeath they aforesaid Messuages, Ground and all the Appurtenances thereunto belonging unto my Grandson William Breathwaite his Heirs and Assigns for Ever. I also give unto my Daughter Ellen now Wife of Richard Carter the Sum of Sixty Pounds for her Sole and seperate Use and benefit Exclusive of her said Husband and so that the same or any Part thereof shall not be subject to his controll, Debts, Contracts, Engagements, Forfeitures, or Incumbrances whatever. And I also give and bequeath upon Trust unto my Son William Breathwaite and James Fielding of Great Harwood Cotton manufacturer my executors herein after named the Sum of Three Hundred Pounds Owing to me by my said Son William Breathwaite to be disposed of by them the said Wiliam Breathwaite and James Fielding in such manner as is herein after mentioned, and upon further Trust that he the said William Breathwaite and James Fielding their Executors or Administrators shall and do either continue the said Principal Sum of Three Hundred Pounds now in the hands of my said Son William Breathwaite or place it out again at Preston Bank or any other New or other Security or Securities at Interest and so from time to time as oft as there shall be Occation and that he the said William Breathwaite and James Fielding their Executors or Administrators Shall and Receive the said Yearly Interest and produce of the said Three Hundred Pounds and pay the whole Produce of Interst Annually unto my daughter Cicely the Wife of William Walne Cordwainer or her Assignes for the Term of her natural Life for her sole and seperate Use and benefit Exclusive of her said Husband and so that the same or any part thereof shall not be subject to his Controll, Debts, Contracts, Engagements forfeitures or Incumbrances, and it is my Will and mind and I Expressly direct that the Receipt of my said Daughter Cicely alone shall from time to time be sufficient discharge for the same Interest, notwithstanding her Coverture, the first payment of which Annual Sum of Interest I order to be paid to my said Daughter Cicely at the End of Twelve Calender Months next after my Decease and with regard to the said Principal Sum of Three Hundred Pounds, and from and after the Decease of my said Daughter Cicely, then upon Trust that my said Son William, and James Fielding their Executors or Administrators shall stand and be possessed of the said principal Sum of Three Hundred Pounds for the Benefit of my two Grand Daughters Ann and Margaret Walne to be Equally Divided between them share and share alike as Tenants in Common and in Case there shall be one such Child then in Trust for and for the benefit of such only Child the Portion and Portions to belong to and be an Interest Vested in the said Children at their respective Ages of Twenty One Years and to be paid to such of them as shall attain that Age in the Life time of my said Daughter Cicily, at the End of Twelve Calender Months next after her Decease and to such of them as shall be under the Age of Twenty one Years at the Death of my said Daughter Cicily, when and so she shall respectively attain that Age. I also give and bequeath unto Grand Daughter Elzabeth Walne, the Sum of One Hundred and Twenty Pounds, when she Arives at the age of Twenty one Years. And I give And Bequeath unto my Son William, and James Fielding, to Each of them the Sum of Five Pounds as a Remuneration, for their Trouble attending the Execution of their Trust of this my Will, to be retained by or paid to them, at the End of Twelve Calender Months next after my Decease. And as to all my Household Goods, Implements of Household and Furniture ready Money, Securities for Money, Cattle, Farming Stock and all the residue and Remainder of my Personal Estate and Effects, whatsoever The same may consist of I give and Bequeath the same and every part thereof unto my Son and two Daughters that is William, Ellen and Cicily, Share and Share alike. And I constitute and Apoint my Son William, James Fielding and my Grandson William Breathwaite when he arrives at the Age of Twenty one Years Joint Executors of this my last Will and Testament hereby revoking all former Wills by me made, and I do direct and declare that my Executors shall not be Answerable or Accountable for any Money to be Received by Virtue of and under the Trusts hereby in them reposed otherwise than Each of Them for such Sum and Sums of Money as they shall Actually Receive and that none of my Executors shall be Answerable or Accountable for the Acts, Receipts, neglects or defaults of nay of them.

In witness whereof, I, the said William Breathwaite have hereunto set my Hand and Seal, this Nineteenth Day of July in the Year of our Lord One Thousand Eight Hundred and Twenty Three.
