In the Name of God Amen being the Twenty Eight day of May in the year of our Lord one thousand seven hundred and sixty seven I James Hoyle of Great Harwood in the County of Lancaster Yeoman infirm of Body but of sound and disposing mind and memory thanks be given unto Almighty God for the same thereon calling to mind the Mortallity of my Body and knowing that is is appointed for all men only to die do Publish and declare this my last Will and Testament in manner and form as followeth and first it is my Will and mind that all my just Debts Funeral Expences and Probate of this my last Will be paid and discharged out of my Personal Estate Item I Give and devise unto John Hoyle my son his Heirs and Assigns all my Messuage and Tenement with the Appurtenances thereto belonging Situate and lying and being in the Township of Rishton within said County Commonly called Tottleworth Lee with a Cubbard in the House a Table in the dining Room with an Ark in the Barn together with all Subject to the payment of six pounds yearly and every year during the Continuance of the said Lease by which the said Tottleworth Lee is held by in manner and form as follows that is to say six pounds yearly and every year to be paid to my three Daughters Rebecca Hoyle Forty Shillings a year Mary Wife of Oliver Houlden Forty Shillings a year and Jennet Wife of Lawrance Clark Widow forty Shillings a year by even and equal Portion first upon the Twenty Second day of November and the Twenty Fifth day of March to them and their Heirs and Assigns except Jennet after her death her share to be divided equally among her Daughters so long as the said Lease continue and it is my Will and mind that if John Hoyle my son die without Lawfull Issue and if there is any Estate or Interest in the said Tottleworth Lee by virtue of the Lease now in being I give and devise the same to James Hoyle my son his Heirs and Assigns subject to the Payment of Twelve pounds yearly and every year to be paid to my said Daughters in manner and form as before written Likewise one Room Called the Parlor at Higher Coulden in Great Harwood which is my Property I give to James Hoyle my son to his Heirs and Assigns I having Assigned the other parts before to him. Item I give to Rebecca Hoyle my Daughter one Cottage or Dwelling House lying and being in Great Harwood aforesaid for and during the Term of the lease with all the Appurtenances thereto belonging with all my Household Goods I have to her Heirs and Assigns All my Bill Bonds and Ready added together into one sum I Absolutely give to be divided equally amongst my three Daughters above mentioned Nevertheless if it happens that any one of the said Legacy happen to commence any suit at law against one another and is not content with what is above written I only give them two shilling and sixpence in full bar and Satisfaction Whatsoever And lastly I do nominate Constitute and appoint John and James Hoyle my sons Executors of this my last Will and In Testimony whereof I have hereunto put my hand and seal the day Month and year before Written
